Terms of Service

Clear guidelines for using our services. Please read these terms carefully before proceeding.

Terms of Service – AteexCloud

These Terms of Service ("Terms") form a legally binding agreement between you ("User", "Customer", "Client") and AteexCloud ("Company", "we", "our", "us"). These Terms govern your access to and use of our website (https://ateex.cloud), billing panel, APIs, servers, infrastructure, and all related services.

By registering, purchasing, or using our services, you agree to these Terms, our Privacy Policy, Acceptable Use Policy (AUP), and Refund Policy.

If you do not agree, you must discontinue use immediately.

1. Eligibility

  1. You must be at least 14 years old or the legal age in your jurisdiction.
  2. If acting on behalf of a business, you confirm you have authority to bind that entity.
  3. We may request identity verification at any time.
  4. Services may not be used in restricted jurisdictions.

2. Account Registration

  1. You must provide accurate, complete, and current information.
  2. False identities or misleading details are prohibited.
  3. Multiple accounts created to bypass limits may be terminated.
  4. We reserve the right to suspend accounts pending verification.
  5. You are responsible for maintaining account security.

3. Services Provided

AteexCloud provides:

  • Free hosting
  • Shared hosting
  • Game hosting
  • VPS hosting
  • Dedicated IP services
  • Add-ons and related infrastructure

All services are provided on an "as-is" and "as-available" basis.

4. Free Hosting Terms

  1. Free hosting is provided at our discretion.
  2. No uptime or backup guarantee applies.
  3. Resources may be limited or modified at any time.
  4. Accounts may be removed for inactivity.
  5. Advertisements or branding may be displayed.

Free plans strictly prohibit:

  • Crypto mining
  • File storage abuse
  • Proxy/VPN services
  • Pirated software
  • Adult content
  • High CPU scripts
  • Automated bots

Accounts may be suspended without notice.

6. VPS & Root Access Responsibility

If your service includes root or administrative access:

  1. You are solely responsible for server security.
  2. You must maintain firewall and system updates.
  3. Misconfigured servers causing abuse may be suspended.
  4. We do not provide system administration unless purchased separately.

7. Payments & Billing

  1. All services are prepaid.
  2. Invoices must be paid before the due date.
  3. Unpaid invoices may result in suspension.
  4. Suspended services may incur reactivation fees.
  5. Taxes (including GST) may apply.
  6. Chargebacks result in immediate suspension and possible termination.

8. User Responsibility for Billing and Account Management

  1. You are solely responsible for managing and monitoring your account, including active services, renewal dates, unpaid invoices, and credit balance.
  2. You agree to log in regularly to review:
    • Active and expiring services
    • Upcoming renewals
    • Outstanding invoices
    • Account balance
  3. AteexCloud is not liable for suspension, termination, service interruption, or data loss caused by failure to check or pay invoices on time. Not logging into your account is not a valid excuse.
  4. You must maintain sufficient credit balance to prevent service interruptions.
  5. While invoice and renewal emails may be sent, you are responsible for ensuring your registered email is functional and monitored. Failure to receive email does not excuse missed payments.
  6. We are not responsible for actions or negligence by third parties managing your account unless formally authorized by us in writing.
  7. Data may be permanently deleted after suspension due to non-payment.

9. Refund Policy

  1. Refund requests must be made within 24 hours of first payment.
  2. VPS services are strictly non-refundable.
  3. No refunds for:
    • Dedicated IPs
    • Domains
    • Setup fees
    • Add-ons
    • Abuse-related suspension
  4. Refunds are issued to the original payment method only.

10. Resource Usage & Fair Use

  1. Excessive CPU, RAM, bandwidth, or disk I/O usage may result in throttling or suspension.
  2. Infinite loops or background abuse processes are prohibited.
  3. Public file-sharing platforms are not allowed without approval.
  4. Crypto mining is prohibited unless explicitly permitted.

11. Prohibited Activities

Strictly prohibited:

  • Malware hosting
  • Phishing
  • Hacking tools
  • Botnets
  • DDoS-for-hire services
  • Spam campaigns
  • Copyright infringement
  • Terror-related content
  • Carding or fraud
  • Blackhat SEO abuse

Violations may result in immediate termination and reporting to authorities.

12. Abuse Complaints

  1. Abuse reports must be addressed within 24 hours.
  2. Failure to respond may result in suspension.
  3. Repeat violations may lead to permanent termination.

13. Staff Harassment Policy

Harassment, threats, insults, slurs, or abusive language toward AteexCloud staff via tickets, chat, or Discord will result in immediate termination without refund.

We maintain zero tolerance.

14. Data & Backups

  1. You are responsible for maintaining backups.
  2. We do not guarantee data restoration.
  3. We are not liable for data loss due to hardware failure, cyberattacks, or user error.

15. Service-Level Agreement (SLA)

  1. Paid plans target 99.5% monthly uptime.
  2. SLA credits must be requested within 7 days.
  3. Credits apply only to future invoices.
  4. Exclusions include:
    • Scheduled maintenance
    • Third-party outages
    • User misconfiguration
    • Force majeure events
    • Abuse-related suspensions

Note: Free plans are excluded from SLA.

16. Dedicated IP Policy

  1. IP addresses remain our property or that of upstream providers.
  2. IP misuse may result in revocation without refund.
  3. You are responsible for maintaining IP reputation.

17. Affiliate Program

  1. Self-referrals and fraudulent referrals are prohibited.
  2. Commission may be reversed if the referred user refunds.
  3. We may terminate affiliate accounts at any time.

18. Reseller Policy

  1. VPS reselling requires written approval.
  2. Unauthorized reselling may result in termination.

19. Intellectual Property

All AteexCloud branding, software, and systems remain our property. Unauthorized reproduction is prohibited.

20. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect or consequential damages.
  • Total liability is limited to the amount paid in the previous 30 days.
  • We are not responsible for third-party failures.

21. Indemnification

You agree to indemnify and hold AteexCloud harmless from claims, damages, losses, and legal expenses arising from your use of our services.

22. Force Majeure

We are not liable for delays or failures caused by events beyond our control, including natural disasters, war, power failures, government actions, or infrastructure outages.

23. Suspension & Termination

We may suspend or terminate services without notice for:

  • Terms violations
  • Non-payment
  • Fraud
  • Security threats
  • Legal compliance requirements

No refunds will be issued for terminated accounts due to violations.

24. Severability

If any provision is deemed unenforceable, the remaining provisions remain valid.

25. Entire Agreement

These Terms, along with our Privacy Policy, AUP, and Refund Policy, constitute the entire agreement between you and AteexCloud.
